There was some discussion on this list concerning the above some years ago -- have a look at the list archives around May 2001 and
July 2003.

Digimarc claims that its watermarking proudcts have been used to achieve numerous out-of-court settlements: see, for example,

There are a few cases in which cartographers have inserted fake streets, rivers, etc. into their maps and used these to prove
copyright
infringements: a British case of Ordnance Survey vs. British Automobile Association was settled out of court and reported in the
Times on 6 March 2001; and an Australian case Universal Press vs. Superguide was settled in the Federal Court as well as reported in
the Sydney Morning Herald on 7-8 July 2001.
