Hi,
I do not think that DCMA specifically relates to watermarking.
DMCA is the implementation in the US laws of the last WIPO treaty (December 1996). In the same way, Europe has implemented the
results of
this treaty in the EUCD (EU Copyright Directive, May 2001).
The concept is that technical barriers protecting the content (such as
Control Access, DRM, Copy Protection System....) are now legally protected: the hack of a technical barrier is forbidden
by the law. This includes for instance a watermarking technique, if used in a DRM.
I would say that content are now protected by three walls of defense:
- Copyright and neighboring rights laws (which date back from the 50s).
- Technical barriers (which has been mostly developed in the 90s).
- Laws protecting the technical barriers (2000s).
However, this brings several issues. One cannot for instance hack a watermarking technique for a research purpose (although
security level
assessment is nowadays a hot issue in the watermarking community): if
this technique is used in a DRM, then, according to the DCMA, you are
an outlaw. This kind of trouble happened to Edward Felton's team in the
SDMI challenge.
